This website (riowheels.in) is owned, managed, and operated by RIOWHEELS. In line with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Copyright Act, 1957 of India, the following statutory disclosures, corporate notices, and legal frameworks are provided for all users, buyers, and third-party entities:

1. Intellectual Property Rights & Custom Background Art Protection

All content displayed across riowheels.in, including but not limited to the RIOWHEELS brand name, logos, website interface, text descriptions, layout structures, collection formats, and promotional graphics, is the exclusive property of RIOWHEELS.

     Proprietary Storytelling Background Art:
Every product listing on this platform features custom-designed, story-driven background artwork uniquely matched to the theme, scale, and historical heritage of the specific model car. These digital images are proprietary creative assets developed through hours of manual graphic design and digital editing by the RIOWHEELS team.
     Strict Anti-Theft Policy (Screenshots & Scrapes): The unauthorized saving, scraping, duplicating, hosting, downloading, or commercial redistribution of our product imagery—including taking screenshots or cropped clips—on any other commercial platform, e-commerce site, social media channel (Instagram, Facebook, YouTube, WhatsApp Business catalogs), eBay, or IndiaMART listing is strictly prohibited.
     AI Alteration & Watermark Removal: Utilizing artificial intelligence (AI) tools, object-removal algorithms, or manual cloning to erase, obscure, smudge, or modify the RIOWHEELS digital watermark, brand tags, or background textures constitutes an intentional, bad-faith copyright violation.

2. Enforcement, Penalties, and DMCA Takedowns

RIOWHEELS actively and systematically monitors domestic and international diecast marketplaces using automated visual-matching indexers (including reverse-image tracking) to detect stolen creative assets. 

If any individual, competitor, or commercial page is found using unauthorized reproductions or screenshots of our proprietary background art, we will exercise our full legal rights without prior warning:

     Immediate DMCA / IP Takedown Strikes: A formal Digital Millennium Copyright Act (DMCA) and Intellectual Property infringement strike will be filed directly with your hosting provider, domain registrar, or social media network (Shopify, WooCommerce, Meta, Instagram, Google), which will result in the immediate suspension or permanent deletion of your online store or business page.
      Statutory Damages & Legal Fees: RIOWHEELS reserves the right to pursue civil litigation under Indian Copyright Law to recover statutory and compensatory financial damages up to **₹50,000 per infringed image**, alongside all legal costs, court fees, and administrative expenses incurred during enforcement.

3. Terms of Use, Inventory, & "Book & Hold" Payment Framework

     Independent Retail Vendor:  Brand names, logos, vehicle designs, and trademarks of the scale models featured (such as Hot Wheels, Mini GT, Inno64, Ferrari, Nissan, Porsche, etc.) belong entirely to their respective corporate trademark holders. RIOWHEELS acts strictly as an independent retail vendor of these authentic collectible items.
     Product Visuals: We ensure our custom backgrounds cleanly showcase the actual scale models. However, minor original factory packaging variations (such as minor card softness or blister edge wear common in imported inventory) do not constitute a product defect.
      Book & Hold Layaway Enforcement: By selecting our "Easy Book With 10%" dropdown option, you agree to secure the in-stock car under a mandatory 30-day payment term. The remaining 90% balance must be settled within 30 days via our verified WhatsApp billing channel (+91 9163917323). The payment can be done using UPI, Razorpay, PayU payment gateway, Internet banking, Amazon gift card, etc. If the balance remains unpaid after 30 days, the hold is automatically dissolved, the item is returned to active stock, and your 10% payment is converted into a RIOWHEELS Store Credit Gift Card. This can be used to purchase any similar or higher priced product. No cash refunds is feasible in this case.

4. Consumer Grievance Redressal Mechanism

In accordance with Rule 5(4) of the Consumer Protection (E-Commerce) Rules, 2020, RIOWHEELS has appointed a dedicated Grievance Officer to handle consumer escalations, payment queries, or policy disputes transparently:

5. Governing Law & Judicial Jurisdiction

This Legal Notice, along with all transactions and interactions executed on riowheels.in, shall be governed by, interpreted, and construed strictly in accordance with the laws of the Republic of India. Any legal disputes, claims, or arbitration proceedings shall be subject exclusively to the territorial jurisdiction of the courts located in Kolkata, West Bengal, India.
